If no proper arrangements have been made for the guardianship of your children, the court will decide what happens to them. In extreme cases, this could mean them being placed in a foster home.<\/p>\n

Clear agreements regarding the care of your children
\n<\/strong><\/span>You can avoid such situations by having a will<\/a> drawn up, specifying guardianship arrangements. You and your partner decide who is to have parental authority over your children and will take care of them. In due course, the named guardian will need to state in writing to the court clerk\u2019s office that he\/she is willing to assume guardianship. Testamentary administration<\/strong><\/span>
\nIf an heir is ill, an addict or too young, they will often be incapable of taking full responsibility for an inheritance.<\/p>\n

If you are worried that this could be the case, you can have testamentary administration included in your will and appoint an administrator to manage the inheritance. You decide at what age the administration will end or what conditions the heir must meet before he\/she can take full responsibility.
