children & guardianship

If you have children, you need to be aware of the possibility of something happening to you or your partner. If no proper arrangements have been made for the guardianship of your children, the court will decide what happens to them. In extreme cases, this could mean them being placed in a foster home.

Clear agreements regarding the care of your children
You can avoid such situations by having a will drawn up, specifying guardianship arrangements. You and your partner decide who is to have parental authority over your children and will take care of them. In due course, the named guardian will need to state in writing to the court clerk’s office that he/she is willing to assume guardianship. Testamentary administration
If an heir is ill, an addict or too young, they will often be incapable of taking full responsibility for an inheritance.

If you are worried that this could be the case, you can have testamentary administration included in your will and appoint an administrator to manage the inheritance.
